1. The agreement

These terms are between you and Berativ - Almalt (CHE-161.844.223), Rorschach, Switzerland — "we", "us". Using Mazmazika means you accept them. If you do not, please do not use the service.

Our privacy policy forms part of this agreement.

These terms are published in English. Translated versions are provided for convenience; if they conflict, the English text governs.

2. What the service is

Mazmazika is a suite of browser-based music tools — vocal separation, chord analysis, notation, ear training, a piano, a metronome, libraries and more.

Several tools use automated analysis. Their output is an estimate, not ground truth. A detected key, chord, tempo or transcription can be wrong, and separated stems will contain artefacts. Use the results with that in mind, especially for anything you publish or teach from.

3. Accounts

Some features work signed out; most need an account. You agree to give accurate details, to keep your credentials to yourself, and to tell us promptly if you think someone else has got into your account. You are responsible for what happens under it.

One account is for one person. Sharing credentials so several people can use one subscription is not permitted.

You must be at least 16, or have a parent or guardian's consent.

4. Plans and limits

There is a no-cost tier with daily allowances, and a paid Pro subscription with higher ones. Current prices, allowances and what each tier includes are on the pricing page, which is the authoritative source — we deliberately do not repeat the numbers here so they cannot fall out of date.

Allowances reset daily. We may adjust them to keep the service stable and to stop abuse; where a change materially reduces what a paying subscriber gets, we will give notice first.

Ads are shown on the no-cost tier. Subscribers see none.

5. Billing and renewal

Subscriptions are billed in advance, monthly or yearly, through Stripe or PayPal. We never see or store your card details.

Subscriptions renew automatically at the end of each period, at the then-current price, until you turn renewal off. You can do that yourself at any time from your account.

If a payment fails we will retry it and may email you. If it keeps failing, Pro access ends and the account reverts to the no-cost tier — your files and work are not deleted because of a failed payment.

If we change the price, we will tell you before it applies to your renewal. You can cancel rather than accept it.

6. Cancelling and refunds

Cancel whenever you like, from your account page. Cancelling stops the next renewal; it does not end the period you have already paid for, and you keep Pro access until that period runs out.

Payments already made are generally non-refundable, because the service is delivered immediately and continuously. That said, if something on our side genuinely stopped you using what you paid for, write to us — we would rather sort it out than stand on the letter of this clause.

If you are a consumer in the EU/EEA or the UK, you have a statutory right to withdraw within 14 days of purchase. Because the service starts immediately, that right ends once you begin using the paid features — and by subscribing you ask us to start straight away and acknowledge that.

7. Your content

Your files stay yours. Uploading something gives us no ownership of it. We take only the narrow licence needed to run the service: to store, process and transmit your material so we can give you the result you asked for. That licence ends when you delete the material.

We do not use your uploads to train models, and we do not sell them. How long we keep them is set out in the privacy policy.

You are responsible for having the right to upload and process what you submit. Do not submit material you have no rights to. Many of our tools can be pointed at copyrighted recordings; whether your particular use is lawful depends on your jurisdiction and your purpose, and that judgement is yours, not ours.

8. Acceptable use

Do not:

  • break the law, or infringe anyone's copyright or other rights;
  • try to get around free-tier limits — multiple accounts, automation, scripted requests;
  • resell, rebrand or redistribute the service, or run it on someone else's behalf as a paid service of your own;
  • scrape, crawl or bulk-download our catalogues beyond what robots.txt allows;
  • attempt to breach, overload or reverse-engineer the service, or probe its security without telling us first;
  • upload malware, or anything unlawful or abusive.

We may suspend or close an account that does these things. Where it is proportionate we will warn first.

9. Our content

The site, its code, design, written content and branding belong to us or our licensors. Your subscription buys access to the service, not a licence to copy or redistribute it.

Instrument samples come from third parties under their own licences and are credited on the sound credits page. Musical works and recordings referenced by our libraries belong to their rights holders.

Output you generate from your own material — stems, charts, scores, exports — is yours to use, subject to the rights in the underlying work.

10. Availability

We aim to keep Mazmazika running and fast, but we do not promise uninterrupted service. Maintenance, third-party outages and faults happen. Some tools depend on external sources — YouTube most obviously — and can stop working when those change at their end, which is outside our control.

We may change, add or retire features. If we retire something a subscriber relies on, we will give reasonable notice.

11. Liability

The service is provided as-is. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, lost data, or the consequences of relying on automated analysis that turned out to be wrong.

Where we are liable, our total liability is limited to what you paid us in the twelve months before the claim.

Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

12. Termination

You may close your account at any time by contacting us. We may suspend or close an account that breaches these terms, or where we must for legal reasons.

On closure, Pro access ends and your stored files are deleted, except records we are required to keep — see retention. Export anything you want to keep first.

13. Changes to these terms

We may update these terms. The date at the top changes with them, and material changes affecting subscribers will be announced on the site or by email before they take effect. Continuing to use the service afterwards means accepting the new version.

14. Law and venue

These terms are governed by the law of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is Rorschach, Canton of St. Gallen, Switzerland. If you are a consumer, this does not deprive you of the protection of mandatory law in your country of residence, or of your right to bring proceedings there.
